It is highly recommended to take action before you get behind on your payments, or as soon as you think you will get behind on your payments, but do not wait until you receive a Notice of Default (NOD). The sooner you start planning the better the results will be. We get requests for assistance when a homeowner has already received a NOD and many more requests after a Notice of Trustee Sale (NOS) has been filed. Although we have had success postponing a NOS and proceeding with a short sale or loan modification, we do not recommend it as many lenders are changing their policies and will no longer cooperate with a request for a short sale or loan modification by a homeowner or broker when a NOS has been filed.
Be careful when hiring consultants, attorneys, or brokers that charge fees before services have been rendered. We have repeatedly heard horror stories from clients who hired consultants, attorneys, and/or brokers who charge fees to work with their lenders promising results, or asking homeowners to sign over title to their property so they can better assist them. This is illegal and in direct violation of Senate Bill 94 (SB 94). As you look for someone to assist you with your situation, be leery of consultants who will charge you hundreds or thousands of dollars to work with you and/or your lender and often times will not start working on your case until they are paid in full. Many clients come to us telling us they hired a consultant, an attorney, or broker and nothing was done, they were charged hundreds or thousands of dollars and are now facing a NOS, but the company or individual(s) they hired can’t help them.
